Lindsay Lohan is out of jail already, her ruling was overturned and she met bail

It turns out that TMZ was right when they said that Lindsay couldn’t be thrown in jail without bail for two failed drug tests, which were misdemeanors. Lindsay’s lawyer filed an appeal on her behalf and her sentence to languish in jail without bail until her next hearing was overturned yesterday. Bail was set at $300,000, she met it, and now she’s out to terrorize the streets once again. The tiny silver lining in this is that she’s been ordered to wear a SCRAM alcohol detection bracelet and to stay out of nightclubs. I’m sure there will be plenty of “drinks spilled” on the device, just as there will be so many important business meetings that she can’t miss held in dark loud bars at 1:00 am.

Lindsay Lohan will be a free woman soon, because a judge has just reversed Judge Elden Fox’s decision and has granted LiLo bail … TMZ has learned.

Judge Fox ruled earlier today … Lindsay could be held without bail. But apparently the Judge’s ruling flies in the face of California law, which gives defendants the right to bail in misdemeanor cases.

Judge Patricia Schnegg, Assistant Supervising Judge for the L.A. County Criminal Courts, just threw Judge Fox’s bail decision out the window. Judge Schnegg has set bail at $300,000.

Lindsay, who is in Lynwood Jail right now, should get out soon … probably in a few hours.

UPDATE 6:02PM PDT: Lindsay will have to get a SCRAM bracelet (this will be her third) within 24 hours — and under the terms of her bail, she is not allowed to be around known drug users … and must submit to search by law enforcement at any time. Also, nightclubs will be a major no-no … Linds has to stay out of places where alcohol is the “chief item of sale.”

UPDATE 10:10PM PDT: TMZ has learned that Lindsay’s favorite bondsman has posted her bail. She can now leave the Lynwood jail as soon as she can get a ride.

Radar Online reminds us that this is the third alcohol-detecting SCRAM device that Lohan has been outfitted with at the age of 24. I’m sure that Judge Fox knew full well that his ruling would be promptly overturned, but he wanted to give Lohan a wake up call that she’s never, ever going to anything other than hit the snooze button on.

If Lindsay was surrounded by people who had her best interests in mind instead of leeches and sycophants someone might put her in an inpatient rehab. Lindsay’s mom won’t even admit that her daughter has already been in rehab four times and that it never took, though, so you know that’s not going to happen. She’s going to drink, drug and go out until her next hearing on October 22 and she’ll be jailed again probably and she’ll get out within a few days to continue doing whatever she wants, earning a living calling the paparazzi and selling her overpriced padded leggings. This woman could have been a movie star, she could have been a TV star, she could have been a pop star. (She wasn’t bad compared to a lot of the crap on the radio.) Now she’s just an entitled addict in denial. There are stories of sadness and regret for lost careers and families in every AA meeting around the world. Some of those people lost much more than Lindsay before they got there.

Lindsay Lohan is “very demure” in her segregated jail cell

Might as well give you all of the details, right? Okay, first up, this is Lindsay Lohan's newest booking photo. This makes three FOUR, and this is the second one of 2010. This is also Lohan's first ginger booking photo! Interesting factoid. Additionally, so immediately after Lindsay's bail was revoked, she was handcuffed and lead away, but first she "looked shocked" and "shot a look at her lawyer." Also - it looks like the cop was molesting her right? Maybe he/she whispered something about "firecrotch." Anyhoodle, TMZ got a statement from Shawn Chapman Holley, who said that Judge Fox had "no legal basis" for denying Lohan's bail. I tend to think that the judge did have a good reason - he told her that if did drugs or drank liquor, she would be going back to jail, and he was just following through. I also think she should sit in jail because I don't want to see her clip anymore babies. Apparently, it is Judge Fox and Judge Fox alone who will get to say when Lindsay gets out, if she does get out before her October 22 hearing. I wonder if Dina will "get him fired" for "playing hardball" with her "child". Also: Lindsay was wearing $1,195 Louboutins for her court appearance. I think Dina got to take them home, because photographers got some pics of Dina carrying a bag of what has been identified as Lindsay's belongings. Shockingly, Lindsay was not wearing SHOE-HANS.

So Lindsay is in jail now. The LA County Sheriff's spokesperson tells media outlets that Lindsay was "very cooperative, very demure and quiet. She’s doing everything that is asked of her.” Demure? She's probably just crack-plotting her next hijink. Also: Lindsay is being segregated from the larger jail population, once again. Look at her f-cking smile before she went into court. She’s such an entitled little bitch.

Lindsay Lohan’s bail revoked, she’s handcuffed & going back to jail

First - only a crackhead would think this outfit looked cute.

Second - Lindsay Lohan arrived at the LA courthouse at 8:08 a.m. PST, and crack standard time. Dina was there, as was Michael, who tried to tell Lindsay that he loved her, and she ignored him. Interesting tidbit: Dina organized a protective order for herself and Lindsay, and asked that the courthouse deputies enforce it, meaning that Michael had to stay a certain distance away from both Dina and Lindsay. Anyway, Lindsay entered the courtroom at 8:22 a.m. and no cameras were allowed in. Shame!

Third - Lindsay is back in custody! Judge Elden Fox denied her bail and she was handcuffed and taken into custody. I think this means The Crackhead is going back to jail until her October 22 hearing. Yes, Radar just confirmed it - she's going back to jail. According to reports, Judge Fox did not hear arguments from either Shawn Chapman Holley or the prosecutor. TMZ is eating sh-t right now because they've been getting leaks from Team Blohan that she wouldn't go back to jail - TMZ says, "It’s shocking because the underlying offense is a misdemeanor, and people connected with the case were telling us the judge had to offer Lindsay bail. As for Lindsay’s reaction … she was shocked when the judge remanded her into custody. Lindsay looked at her lawyer, Shawn Chapman Holly, before being taken out of the courtroom." JUSTICE.

Kat Von D’s ex-husband reveals more about her shady past

I mean… how can you not love this photo? Let's face it, we all have photos like this, where we look hideous and like we have massive double chins. We don't all have ex-husbands who sell our bad photos to the tabloids, however. This pic was provided to us by In Touch Weekly, who seem to have quite a thing going with Kat Von D's ex-husband. As you may remember, her ex, Oliver Peck, already told ITW that Kat was a piece of work when he was married to her, calling her a user, a cheater and a famewhore. In his second interview, Peck describes Kat's eating disorder and her past drug usage, and how she didn't even think Jesse James was very cool when they first met.

Jesse James' new girlfriend, Kat Von D, once said she'd like to be remembered as "a good friend to everyone." But if that's what she wants, she may have a long way to go, Oliver Peck — who owns Elm Street Tattoo in Dallas and was married to Kat from 2003 to 2007 — tells In Touch in an exclusive interview.

"She's the most self-centered person I've ever been involved with," he shares. "Toward the end of our marriage…she was wanting to get liposuction, and she was taking drugs in order to lose weight."

Her newfound fame changed her in other ways, too. Kat "got to the point where she was drinking until she was throwing up every day," shares Oliver of the 28-year-old, who finally got sober in 2008.

"She'd be incoherent and sometimes destructive." Oliver says he tried to stand by her — until a friend told him "she was having an affair."

The idea of a marriage-ending affair is ironic, considering that her new boyfriend is one of Hollywood's most notorious cheaters.

"Kat and I met Jesse and Sandra [Bullock] about four years ago at a party," reveals Oliver. "Kat said she thought Jesse wasn't very cool."

Sour grapes? Eh. I think this guy is probably telling the truth - or at least, this was his experience. But I do think he sounds extraordinarily bitter, and like he's not through obsessing over their marriage. That being said, Kat does sound like she has serious issues, and those issues aren't going to heal themselves while she's dating some Nazi-skank-boning douche. Or maybe she and Jesse deserve each other? Eh.

Stephen Colbert testifies before Congress, draws huge crowds

Stephen Colbert testified before a judicial sub-committee this morning, and into the afternoon. Colbert was asked to testify by the committee's chair, Rep. Zoe Lofgren, and by the president of the United Farm Workers, Arturo Rodriguez. You see, the UFW ran a program called "Take Our Jobs" where they offered any takers the chance to experience the career choice of "migrant worker." Colbert took them up on the offer, and worked a ten-hour day on a farm. So Colbert has many thoughts about the state of migrant workers and the state of American farms and immigration and all of it. When he was asked to testify, people didn't know if they would get Stephen Colbert, Catholic Sunday school teacher, father, husband and concerned citizen, or whether they would COLBERT, hilarious comedian/performance artist. Guess which one they got? Here's Politico's (snide) take… I think Colbert must have farted on Politico's croissant.

Comedian Stephen Colbert commandeered a hearing on migrant farm workers with lewd one-liners Friday morning, creating a public relations pile-up at the tail end of a legislative session that is limping into a pre-election recess. It was lost on no one that the Comedy Central faux news anchor delivered his off-color rant against the backdrop of the House canceling floor votes for the rest of this week as Democratic leaders struggle to reach consensus on how to move a simple stopgap spending bill that will prevent the government from shutting down on Oct. 1.

“I would like to submit a video of my colonoscopy into the Congressional Record,” he told mortified lawmakers at one point.

“Sorry for saying cornpacker, I know it’s an offensive term for gay Iowans,” he told conservative Iowa Rep. Steve King.

He made reference to getting a “Brazilian” — a wax-based hair-removal service in a very delicate area of the body — from a Chilean at a spa serving tomatoes sliced by a Guatemalan. Colbert's comedic rant was also a sleight of hand – his "prepared" testimony was passed out to the media before he spoke, and it was a bland, seemingly straightforward speech on migrant workers in America.

An aide to Speaker Nancy Pelosi (D-Calif.), who has met with Colbert in the Capitol in the past and even signed the cast on his broken arm a few years ago, did not immediately respond to a request for comment on the hearing.

Rep. Judy Chu (D-Calif.) defended Colbert’s appearance, noting that Republican-led committees had invited celebrities such as Elmo the muppet to testify in the past. But it’s not as if some Democrats on the committee couldn’t see the disaster coming. Judiciary Committee Chairman John Conyers (D-Mich.) implored Colbert to simply enter his testimony into the record without speaking. Some in the room gasped. Colbert muttered into the mic: "No hablo Ingles," before straightening up and asking Rep. Zoe Lofgren (D-Calif.), the subcommittee chairwoman, if she'd prefer if he left the room. She did not.

Colbert began speaking after Conyers withdrew his request — quickly moving past his somber prepared remarks in favor of the sort of comedy featured on his show.

"Please don't make me do this again, it is really, really hard," Colbert said of spending a day in the fields at the invitation of the president of the United Farm Workers union. "Most soil is at ground level. If we can put a man on the moon, how come we can't make the earth waist-high. Come on, where is the funding?!"

Colbert’s comically aimed testimony missed its mark at points, making a mockery of Congress and perhaps also of the issue he claimed to champion. News that Colbert would be testifying on the Hill had some fans lining up as early as 6:30 a.m. for a seat in the committee room. Code Pink protestors turned out, as did a slew of TV cameras. Lofgren warned the audience to "maintain decorum" — and noted Capitol Police were on hand to remove hecklers.

Not surprisingly, the conservatives whom Colbert pillories nightly were unamused by his presence, with some complaining that it was a waste of government resources.

"A few years ago when debating himself on his show, he asked 'Don't we want to have cheap labor for all the jobs we don't want to do?" Rep. Lamar Smith (R-Texas) recalled. He responded "Yeah, unless you're an American landscaper or an American construction worker." Then he added "But I am an American TV host. My job is safe."

"Millions of Americans wish they didn't have to compete with cheap foreign labor and had such a safe job," Smith said.

'Maybe we should spend less time watching Comedy Central and more time looking for the jobs that are out there," said Iowa Rep. Steve King, the ranking Republican on the subcommittee. He also argued that it was insulting to imply that migrant workers were taking jobs Americans didn't want.

Rep. Howard Berman (D-Calif.) shot back that there's nothing in the UFW's "Take Our Jobs" campaign that implies "Americans aren't doing hard work, and if the gentleman from Iowa were deeply concerned about the conditions on the farms and the wages, I would have noticed more activity to makes sure that a number of the laws that apply to all Americans apply with equal force to all Americans who pick fruits and vegetables in our country."

It’s clear Colbert succeeded in drawing attention to his testimony — whether that advances the cause of migrant farm workers or the Democratic lawmakers who asked him to appear remains to be seen.

Yeah… watch the video and you'll see how actually funny he was. And you know what? He did bring a lot of attention to the issue. And now we know which congressmen have sh-tty senses of humor.

By the way, Colbert made a hilarious comment yesterday, before his testimony: "Republicans are concerned that I will make light of the responsibility of governance? That I will someway impede the smooth flow of the governing of this country? I take exception with that."

Polygamist reality show family say husband met fourth wife through his first wife

A couple of weeks ago, we covered the news that another family with too many kids was coming to TLC’s reality lineup. Except in this family several women have those kids and it’s not a case of extreme IVF or a cultish adherence to having children whenever it’s physically possible. Sister Wives, about a polygamist family in Utah with one dad, four wives, 13 biological kids and three step kids, premieres this Sunday. The show chronicles the daily life of the Brown family, who all live in the same home with separate apartment-type units for each wife. The dad has a kind of schedule he uses to rotate through the women, who say they occasionally get jealous but they get over it.

Kody and his four wives were on The Today Show yesterday (videos below) and I have to say they seem like really nice people. As I said in my first story on this, however they want to live is up to them. It’s technically not illegal as Kody is only married in name to his first wife and not to all the other women he’s having kids with. If they all want to live together to raise their children among one guy more power to them. They said on the Today show that they manage to make ends meet because most of them work.

The thing that bothers me is that they’re really potentially hurting their children by both going public with the way they live and by making a reality show out of it. I understand that they hope to increase awareness and acceptance of polygamy but they’re opening their family up to so much and I doubt they realize what they’re in for. The say they’re prepared for it, though, and that they work hard to give their kids a normal life.

One interesting thing I learned on The Today Show is that Kody’s first wife is the one who introduced him to his fourth. A viewer asked how he had time to meet the fourth wife with three wives at home and they explained that he didn’t do it at all. Meri, 39, Kody’s first wife, explained “Robyn and I found each other actually… we weren’t looking, it just happened.”

Robyn, 31, explained that “at that point I was a single mom and was open to it [polygamy]

Christine, Kody’s third wife, 37, gave their reasoning for starring in a reality show. “Polygamy is a hidden culture. We really don’t want to be hidden anymore. We really would like it to be more open. We’d like our children to have the benefits of living in an open society. I was raised in this lifestyle and really kind of fear-based and I’d rather not have that for my children.”

As to whether they’re worried that a reality show will hurt their family and/or their children, Janelle, Kody’s second wife, 40, says “I think we have doubled our efforts to make sure they maintain a normal life… we are protective of them.”

Kody added that having four mothers makes their family that much more stable. Yeah, they don’t know what they’re getting into.
