Ya Don’t Say: Burger King-Hush Mouthed Over Unwrapped Condom in Whopper Scandal Posted: 16 Oct 2010 12:27 PM PDT Yesterday we posed the question: How much do you think Burger King paid to settle the lawsuit over the unwrapped condom in this kid’s whopper? Well, as it turns out, the alleged victim has dropped the lawsuit! The plaintiff’s attorney, Devin McLaughlin, said Friday that the details of the settlement are confidential and won’t be disclosed, but the owner-operator of the Rutland restaurant says forensic analysis of the object and surveillance video prove it didn’t originate in the Burger King. “That was, from our side, pretty conclusive,” said Joseph Zirkman, vice president and general counsel for Carrols Restaurant Group Inc., of Syracuse, N.Y. “They agreed to drop their claim and we agreed to drop our counterclaim. The parties agreed to pay their own legal costs, so you can draw your own conclusions.” In 2007, Van Miguel Hartless sued the store’s owners, who denied the claim and filed a countersuit. At the time, Hartless was a student at Green Mountain College. He claimed he bit into a Southwestern Whopper and found a condom, which he said caused him “sustained pain and suffering, vomiting, nightmares, mental and emotional distress” and medical expenses. He couldn’t be reached for comment Friday. He has since moved to El Paso, Texas, and efforts to reach him by telephone were unsuccessful Friday. He did not respond to a request for comment sent to him on Facebook, and his lawyer wouldn’t say where he lives or make him available for comment. “The lawsuit has been resolved upon terms acceptable to each of the parties, and those terms are confidential,” McLaughlin said. Under the stipulation agreement signed by the parties, the record in the case was sealed. The Rutland Herald, which first reported the settlement Friday, says Hartless and the company asked a court on Oct. 6 to dismiss the case. Hmm. So, did Burger the King cut dude a check or did they call his bluff? Is he sippin’ on Patron margaritas and beastin’ on five-star El Paso TexMex thanking BK for f*ckin’ up so nice? Or is he scraping up change to pay his lawyers? Guess we’ll never know, huh? Either way, hush money from fast food chains is never short.

Besides the sensational value of the scandal, the Eddie Long issue has put some of the most serious questions about organized religion on the table. If Long is proven guilty, he will represent the latest religious leader to symbolize hypocrisy in the church; while he vehemently condemned homosexuality as a leader for the New Birth Missionary Baptist Church, he was involving himself in sexual wrongdoing with young men. They say with age comes wisdom and it seems that Kim is making smarter decisions when it comes to her personal life. In a recent interview, Kim talks about her new soulmate, dating in the public eye and being happy happy… im Kardashian’s soulmate at the moment? Her sister Kourtney. The two siblings are holed up in a downtown New York hotel for six weeks, shooting their latest foray into reality TV. Their new series, Kim and Kourtney Take New York, will premiere on E! in January 2011… “This was like, for me, the perfect time to come to New York because I’m single, because I just felt like I kind of wanted a fresh start,” says Kim Kardashian… Her split from New Orleans Saints football player Reggie Bush was chronicled on her show. And Kardashian is open about how stressful dating can be, especially when so much of your life is so public and ends up in the tabloids. “It’s all a learning experience. I think I’m still trying to figure it out. That’s why I think it’s probably best for me to be single right now. It’s a lot easier than to try and figure out who likes me for really me (and) who wants to be on a show. It’s definitely a process,” she says. Kardashian says that dating while being on TV isn’t exactly a recipe for romance. It’s definitely hard to date when you live your life on a reality show,” says Kardashian. “How do you say to someone, ‘Hey, are you cool with dating me on my show? Are you comfortable being on the show?’ It’s really hard. I’m definitely more open to dating when I’m not filming, when it’s our off season.” She’s made a lot of good business decisions but when her love situation comes into play, she probably got away from the love and started treating it like it was a business… Doing what she thought the would look good in the eye of the fans and not going with her heart, but who really knows.
